Environmental Law at teachlegalenglishWe will look at a number of treaties, protocols and conventions, including - the United Nations Conference on the Human Environment, Stockholm (1972), - the World Commission on Environment and Development (1983), - the United Nations Conference on Environment and Development, including United Nations Framework Convention on Climate Change (1992) with its Kyoto Protocol (1997) - the World Summit on Sustainable Development (2002). We must be mindful that there are over a 1000 environmental law treaties in existence today, some almost universal, some multilateral, some just bilateral. Environmental Law can be seen to be organised around a number of core principles - national sovereignty, legal reciprocity, comity and the Golden Rule, the polluter pays principle, the precautionary principle, the principle of sustainable development, environmental procedural rights, common but differentiated responsibilities, intragenerational and intergenerational equity, a common concern of humankind, good neighbourliness and a common heritage for all. Judicial decisions International environmental law cases are adjudicated at a number of international and regional venues, and sanctions, damages and injunctions are issued from - the International Court of Justice (ICJ) - the international Tribunal for the Law of the Sea (ITLOS) - the European Court of Justice - European Court of Human Rights - even at the World Trade Organisation. Protecting the environment is now arguably a function of the governance of every state, where implementation, monitoring, compliance and enforcement bodies have been set up and are functioning alongside national and international non-governmental environmental organisations. |
